Ley de Memoria Democrática for Spanish Nationality: A Guide for Residents in Spain

Last Updated on April 18, 2026 by Bruno Bianchi

Question

Is it be possible to acquire Spanish nationality under the “Ley de Memoria Democrática” already being a resident in Spain (going through the process here, I mean)? Or would I have to apply for it at my home country’s Spanish consulate?

I would rather not have to take the CCSE and DELE that are required when applying for Spanish nationality by residence.

These are the answers of Spainguru’s Facebook group members:

“I’m from a former colony and the application itself was approved in 4 months. I don’t know how long it is for Ley de Memoria Democrática… i think that’s his point. If I wasn’t living in Spain & qualified, I would’ve done that.  But if you’re already here 2 years as a resident, then he suggests to do the “by residency” option.”

“Citizenship through Ley de Memoria Democrática is considered nacionalidad por opción, so you should be able to apply for it from within Spain at the Registro Civil here in Madrid. Link to Ministry of Justice website

Conclusion:

The “Ley de Memoria Democrática” offers a unique pathway to Spanish nationality. This legislation allows for the application process to be carried out within Spain, making it accessible for current residents.

This Law would permit avoiding the exams of CCSE and DELE (language exam), that can be potential drawbacks for non-Spanish speakers like nationals of the Philippines.

Ultimately, the choice between applying from within Spain or from a consulate abroad depends on individual circumstances, including potential processing times and specific eligibility criteria under the law.
