Understanding the 90-Day Rule for Non-EU Partners in Spain
The 90-day rule applies to non-EU citizens visiting the Schengen Area without a visa. Under this regulation, you can stay for a maximum of 90 days within any 180-day period. This applies regardless of whether your partner is a legal resident of Spain — your immigration status is evaluated independently.

See Vetted Lawyers →If your partner is an EU citizen or has permanent residency in Spain, you have options for staying longer. You can apply for a Tarjeta de Familiar de Comunitario (EU Family Card) if your partner is an EU/EEA citizen. Alternatively, if your partner holds a Spanish residence permit, you may be able to apply for family reunification (reagrupación familiar), though this process has specific financial and housing requirements.
Overstaying the 90-day limit carries serious consequences including fines, potential entry bans to the entire Schengen Area, and complications with future visa applications. If you need to stay longer, it’s always better to apply for the appropriate visa or residence permit before your 90 days expire.
