”Your husband is Spanish so you should do arraigo familiar, not EU family. Technically you are not entitled to the EU family card because your partner is not an EU citizen exercising FoM Treaty rights in Spain. If uou live in a region that hs not yet implemented the 2022 ruling then you might get lucky. Otherwise I would investigate the arraigo familiar process and requirements. ”Well, my friend went through the same process and I will explain to you how it works. 1) The economics means should be about 11,500 euros and the money should be in your husband Spanish account. Yes, I said Spanish bank account take note. 2) investment stocks do not count; hence, it’s not an option. 3) Since you already have the result for your renewal, this will not affect your application for Tarjeta comunitaria since you have no pending application.”

”Where are you guys located in Spain? I just posted a few days ago asking for advice on a very similar situation (mine is through PDH with my Spanish bf, not marriage, and I’m American, not sure about your situation). I am trying to find a lawyer to consult with on which process I need to use (TC vs arraigo familiar) as I was informed the legislation changed in 2022. The background check sucks, but it seems like it would be the only thing we might be able to apply for”

Conclusion

In conclusion, insights from Spainguru Facebook group members indicate that for Spanish residency, personal circumstances such as marriage or partnership are crucial in determining whether to apply for Tarjeta Comunitaria or Arraigo Familiar. Following the immigration regulation changes in 2022, it has become evident that in cases like this, pursuing the Arraigo Familiar route is the more appropriate option.
