A1: I don’t know the paperwork required for 1099, but everything my attorney said I needed, my company and I provided. All apostilled and sworn translated.
Q2: Did your company register in Spain to withhold social security locally?
A2: No, we didn’t have to do this.
Q3: How feasible is it to apply for a Spain Digital Nomad Visa as a W2 employee?
A3: It is challenging and risky to apply as a W2 employee due to specific legal and administrative requirements that are typically geared more towards contractors or self-employed individuals. However, it turned out to be possible for me and a few others. The critical factor was the support and guidance from experienced lawyers who understood how to navigate these complexities.

A4: The Social Security Certificate from the US, which confirms that I remain covered by US social security and Medicare, was a pivotal document. Typically, this certificate doesn’t cover remote workers effectively, making cases like mine less common and more complicated. The certificate needed to be applied for by my employer rather than myself, which might have been a significant factor in the successful outcome of my application.
