Question
I just wanted to ask has anyone successfully obtained residency for their partner as a third country national through pareja de hecho then the regrupación familiar visa? I’m British and I have a Spanish residence permit, my partner is from the US and I wondered if it would be possible to obtain residency for him this way. We understand it would take a while but we wanted to know if it’s even worth trying this route/ a feasible option
Answers
These are the answers of some Facebook group members:
“No… If you were Spanish, then yes. Having residency does not give you a way to give another 3rd country national residency. He needs to go through the visa process Luke the rest of us.”
“Yes, third country nationals residing in spain can request family reunification visas for their family members. it is a slow process that has a lot of limitations and requirements, but it exists. The process is called reagrupación familiar. Any resident can apply for it after being legal here for a year.”
“Broadly speaking yes, but whether pareja would work for this i’m not sure. if you were married then for sure.”
“With Pareja de Hecho it is only possible when one is Spanish, just like marriage, as pdh is common law partners”
“I’m going through the reagrupación process now, but we’re married not PDH. I’m British and my husband is Argentine.”
“Im about to start the process too. My partner is British with residency and I’m from NZ. I have been doing my research and I think it’s possible with PDH.”
“There is also an option called reagrupación familiar which is what I’m doing at the moment with my husband, neither of us is from the EU but as I have residency and we’re married he can live and work here. I’ve almost completed the process with a lawyer so I know it’s possible. Group member we started the process with a lawyer in February. The first part was getting the “informe de vivienda adecuada” which should have taken a month but took 3 months. Then the lawyer presented all the documents in May and we got the favorable notification at the end of September, now the second part is submitting more documents to the embassy to get the actual visa, which is what we are doing at the moment.”
“Residency through PDH is possible without being Spanish or an EU citizen. One of the parties just needs to be a long-term resident (not student). And as others have mentioned it is called Reagrupación Familiar. I know lawyers and friends who have done and completed the process and had even brought their children over to Spain.”
“I am a lawyer for foreigners, I process many unmarried couples (parejas de hecho) and they have accepted all the applications for residence and work for the non-European family member. It is a very good option but you have to know how to do it well. I encourage you to start it. It is a very good card.”
