Finally, I got approved! (after being initially denied)
I was about to lose hope, but the universe saved me today.
My profile and application journey in bullet points:
Nationality: Filipino (Philippines, para sayo ang laban nato)
Current status in Spain: I am an auxiliar (English language assistant) and a master’s student on a student visa. My TIE is about to expire on June 30. I hope that this post of mine will give hope to a lot of auxiliares out there who wish to switch to DNV! It’s possible!
Applied as an employee.
Hired a law firm.
Date of application submission: March 1
Date of receipt of denial: March 28 2023
Grounds for denial: Monthly income does not meet the DNV income requirement.
Date of appeal submission: March 31 2023
Date of receipt of appeal result: June 20 2023 (see attached screenshot so you will have an idea of what an appeal result, that negates the initial negative decision, looks like)
I did not submit the following (yet I still got approved):
- Certificates of good standing/incoporation
- Contracts
- Any letter with wet signatures or stamps
My digitally signed letters of employment with complete details were deemed sufficient, I guess.
My educational background also has no relevance whatsoever to my current online jobs.
Questions & Answers
Did they let you use savings to top up your income? Wondering why some need all the contracts and certificates and some don’t. It seems very inconsistent
On my appeal I included all my bonuses, which helped me achieve the DNV minimum income requirement (just barely though). I also submitted my savings. I think I just got lucky in a way. Best to still submit all of your certificates, contracts, etc. just to be on the safe side.
You have been an employee of the company for at least 3 months, so even while you’re an auxiliar?
Yes, that’s correct!
Since you we’re working, did you apply for the 30 hours per week part time work as an aux? I thinking if they’ll still look for your “legality to work” since you were already in Spain for at least a few months and you submitted that you’ve been working remotely
My TIE did not come with any work authorization. So it was a big gamble to apply for the DNV on a student visa. The risk paid off though!
I’m assuming the initial reject reason was a mistake and your income was sufficient with the requirements?
Yes! But on my appeal I already included my bonuses and clearly stated my gross annual salary. My bonuses helped me to achieve the minimum income requirement for DNV. I barely reached it!
What did you have to do in regards to social security?
I just sent a letter promising that I will continue to pay for my SSS coverage in my home country. I wouldn’t really recommend that you follow what I did because I think I just got lucky. If you are a Filipino, then best to just submit a certificate of membership coverage for the social security requirement.
Does this mean you don’t have to pay for social security in Spain? since you said you’re gonna continue with SSS?
For now, my answer is yes because I will keep on being covered by the SSS in the Philippines. But I will have to do more digging about this.
What did you provide as proof of income just the coe?
The usual! Letter of employment, pay slips, and bank statements
Did you provide the bank statement or only the invoices and pay stubs?
I did not provide invoices. Just pay slips, COE, and bank statement.
