Answers

These are the answers of some Facebook group members:

”If you are planning to apply from within Spain then get all your documents together and have them change him to independent contractor status when you are ready to leave. Leave within the month that you start his contract, come to Spain, apply for the DNV 3 months after his contract start date … you will be with the 90 day Schengen visa time so you will be fine. Then pay your taxes on that income in Spain. Contact a professional and get on their calendar to submit your application in the correct timeframe. They are really busy so you need to plan and schedule in advance”

”My only issue is we are bringing our young children, so our plan was to apply in Spain on a short visit over there, then return to the UK. They are at school/nursery so we can’t really pull them out ’til we have some guarantees”

In conclusion, according to Spainguru Facebook group members, transitioning from employment to contractor status in the UK for visa reasons involves careful planning, considering IR35 regulations. Seek guidance from immigration experts who specialize in visa and IR35 matters, and plan the timing of your transition carefully. If you have dependents like young children, consider their needs and schooling when making the switch. Planning and professional advice are key to a successful transition while complying with all relevant regulations.
