The message is clear: the system is becoming more structured, more specialized, and significantly stricter. Below is a detailed breakdown of the key changes affecting both new applications and renewals.

The Digital Nomad Office, under the Unidad de Grandes Empresas (UGE), has undergone internal reorganization.

Key structural updates include:

  • A more experienced and specialized review team
  • Greater scrutiny of documentation
  • Stronger enforcement of compliance
  • A reinforced Quality Control Unit (Unidad de Control)

The primary reason behind these changes is an increase in fraud cases and failures to register properly with Spanish Social Security.

The Two Main Types of Fraud Detected

Authorities highlighted two recurring issues.

First, fake or manipulated documentation. This includes fabricated work contracts, non-existent companies, and false company registrations.

Second, agent misconduct. Some agents have reportedly reused documentation across multiple clients by simply changing names. When fraud is detected in one case, all applications handled by that agent may be reviewed or cancelled.

The direction is clear: compliance is now being monitored more aggressively.

Updated Requirements for Initial Applications

100% Remote Work Must Be Clearly Stated

The job title and job description must clearly reflect a fully remote position. The description must not imply physical presence, production management, or any activity requiring in-person work. Vague wording can lead to rejection.

Degree Homologation Clarification

If you are not practicing a regulated profession in Spain, you do not need to homologate your degree. You also do not need to file a declaration stating that you will not practice your profession. However, university degrees must now be apostilled.

Autónomo Registration

Autónomo registration does not need to be completed on the same day as residency approval, but it must be done as soon as possible. The UGE’s Quality Control Unit now verifies whether applicants are properly registered with Spanish Social Security after approval.

Business Owners: Proceed Carefully

Applying directly as an Owner or Director is strongly discouraged. Doing so may require registering the company in Spain, trigger additional tax obligations, and potentially disqualify the applicant from Digital Nomad residency. Business owners are advised to apply as contractors or employees of their company instead. Structuring the application correctly is critical.

Income Requirements

For families of two or more, the minimum income requirement is €43,000 per year (approximately €3,583 per month). If the income threshold is not fully met, applicants may supplement it with savings.

Certificates of Coverage

Certificates of Coverage are accepted under specific conditions:

  • United States: Certificate of Coverage plus a Letter of Displacement
  • United Kingdom: A1 certificate
  • Other countries such as Canada, Colombia, or Russia: Certificate of Coverage plus an additional document from the national Social Security authority confirming remote work status

Self-Employed Applicants

Self-employed individuals and contractors must demonstrate at least three months of registration in their home country prior to applying.

Switching from Non-Work Residencies

It is not possible to modify from a Spain Non-Lucrative Visa or any other non-work-related residency into the Digital Nomad residency.

Renewal Requirements

Renewals now emphasize tax compliance and genuine residency in Spain.

Applicants must provide:

  • Their Spanish tax declaration from the previous year
  • Proof of fiscal tax residency in Spain
  • A valid TIE card
  • Only the biometric passport pages (not the entire passport)

For autónomo-to-autónomo renewals, only one month of invoice and income proof is required. The same Certificate of Registration may be reused.

For family members, a Declaration of Maintenance of Relationship can replace new marriage or birth certificates.

Bank statements must come from a Spanish bank account showing autónomo payments.

Stronger Post-Approval Compliance Checks

The Unidad de Control now verifies:

  • Proper Spanish Social Security registration
  • That positive administrative silence cases genuinely meet legal requirements
  • Ongoing compliance after approval

This represents a shift from simple approval-based processing to active monitoring of compliance.

What This Means for Applicants

Spain’s Digital Nomad Visa remains one of Europe’s most attractive residency options for remote workers. However, the authorities are tightening enforcement to protect the integrity of the program and prevent abuse.

Applicants must ensure:

  • Clear and accurate documentation
  • Genuine remote work arrangements

  • Real tax residency in Spain
