Last Updated on April 18, 2026 by Bruno Bianchi

Question

If I’m currently an auxiliar de conversacion wanting to modify to the Spain Digital Nomad Visa, do I have to wait for the 60 day period prior to my TIE expiration date or can I apply now? My TIE expires in September 2024 and we are in February 2024.

(Lawyer answer) “You can submit it now. The important thing is to demonstrate that you are in a regular/legal situation in Spain. If you have more questions contact Sterna abogados.”

Conclusion

For auxiliares de conversación considering a switch to the Spain Digital Nomad Visa (DNV), the timing of the application relative to the expiration of their TIE is flexible. It’s possible to initiate the application process before the 60-day period preceding the TIE’s expiration date, as long as the applicant can prove they are legally residing in Spain.

This flexibility aims to facilitate a smoother transition for those looking to modify their visa status while ensuring they remain compliant with Spanish immigration laws.
