Question
“Are there any Filipinos here who have successfully obtained their Spain Digital Nomad Visa even as regular employees, not just as contractors? Any tips or insights regarding the Phil-ES bilateral agreement would be greatly appreciated!”
Answers
These are the answers of Spainguru’s Spain Digital Nomad Visa group members:
“Only if applying in the Philippines. Not in Spain. Unless your company has a branch in Spain that they’re sending you to, the Social Security won’t issue the necessary certificate. I know someone who was approved here in Spain but I think that was something that UGE overlooked.”
“So it means we can still apply as a regular employee and can still acquire or apply for permanent residency?” “Yes, but you’re limited to the 1-year visa. If you want to apply for the 3 years in Spain you’ll have to switch over as a contractor. Otherwise, your application will likely be denied.”
“I am in the process of collecting documents. I heard that if you apply for Spain Digital Nomad Visa in the Philippines, they will give you 1 year but 3 years when you do it in Spain.
Is it wise to do it in the Philippines and would it be a hassle to apply again for the 3 years in Spain?” – “You’d only be able to apply for three years in Spain if you’re self-employed / an independent contractor. If you’re an employee your only choice is the Consulate.”
“I’m a contractor so…” – “Then you’d have no issues applying from within Spain whether initially or after already having received a one year visa from the consulate.”
Conclusion
For Filipinos seeking the Spain Digital Nomad Visa (DNV), the route to approval may depend significantly on their employment status—whether as regular employees or independent contractors.
Regular employees face limitations and can typically only secure a one-year visa when applying through the Philippines, necessitating a transition to a contractor status to extend or reapply within Spain for up to three years.
Self-employed individuals have more flexibility and can potentially secure longer visas directly from within Spain.
Understanding these nuances is crucial for planning an effective application strategy.
