UK Citizen with a 5-Year Visa in Spain: Can I Study Abroad Without Losing Residency?

Last Updated on April 18, 2026 by Bruno Bianchi

Question

I am a UK citizen with a 5-year visa in Spain under the Withdrawal Agreement. I understand that with this visa, I am not allowed to be absent from Spain for more than 6 months in any given year or for a full year within a 5-year period.

However, I am considering pursuing a Master’s in the UK next year and would like to know if there are any exceptions to this rule, particularly for studying abroad.

Answers

These are the answers of Spainguru’s Facebook group members:

“Temporary absences of up to six months per year are allowed, but studying abroad is an exception allowing a maximum absence of 12 consecutive months.”

“Residency holders under the Withdrawal Agreement are not subject to a visa but have legal residency for five years. A 12-month absence for study purposes is permitted.”

“As long as you maintain your legal residence in Spain, such as being registered on the padrón and keeping up with any residency obligations, your status should remain valid.”

“You only need to ensure your absence is justified as study-related and does not exceed 12 months. Returning home for holidays during the study period can also help maintain residency continuity.”

“Residency continuity is affected only if absences are longer than 12 consecutive months or if required documentation is not submitted during renewal.”

“Studying abroad in the UK is not counted as a regular absence under the Withdrawal Agreement rules, provided it is within the allowed timeframe for educational purposes.”

“It’s wise to consult an immigration lawyer specializing in the Withdrawal Agreement, as the rules can be complex and interpretations vary.”

Conclusion

Studying abroad as a UK citizen with a 5-year visa under the Withdrawal Agreement in Spain is possible without losing residency if the study period does not exceed 12 consecutive months.

Ensure you remain registered on the padrón and comply with all residency obligations.
