“You need an autorización de regreso. I had to get one. The hardest parts were:

  1. Getting the police station appointment.
  2. The police were a bit strict about my appointment being close to my travel date.

I had an immigration law firm assisting me. They got the appointment quickly through some means (they initially told me it might take three weeks). Their translator convinced the police to accept the timing despite limited appointment availability.”

“On re-entry to Spain, the passport control police are supposed to keep the regreso, but sometimes they don’t. In my case, they did take it. I would recommend keeping it handy if you need to travel again before receiving your TIE.”

“If you’ve just arrived (not renewing) and the visa stamped in your passport is still valid and allows multiple entries, then yes, you can leave.”

Can I Leave Spain While My TIE Card Is Being Processed?

“This question keeps coming up. Technically, yes, but depending on the circumstances, you may need an autorización de regreso. The official link for details: Autorización de regreso – Policía Nacional.”

“As long as you have a regreso, you’re fine. Take that along with the document proving your application is being processed, and you’ll have no problems.”

“You can leave, but it’s risky. As a US citizen, if I’m not mistaken, you may need to wait six months before coming back to Spain. If your TIE is approved during that time, you only have 30 days to claim it, or it will be forfeited.”

Conclusion

Leaving Spain while your TIE card is being processed is possible under certain conditions. Most members recommend obtaining an autorización de regreso, which acts as a re-entry permit.

Here’s the official Autorización de Regreso procedure.

This document, combined with proof that your TIE application is in process, allows you to leave and return without issues.

If your visa is still valid and permits multiple entries, you may not need the regreso.

However, it is advisable to confirm your specific situation with a lawyer or immigration expert, as policies and interpretations can vary. Planning your travel and securing the necessary documents beforehand will help ensure a smooth re-entry.
