“In the EU, the days don’t just count for Spain, so be careful. There are a lot of 180-day stay tracker and calculators on the web that you can use.”

“Does that mean that a person with a Spanish DNV can stay anywhere in the EU during the 6 months rest of the time out of the EU, and that will be counted towards the 6 months?” – “No”.

“It depends on your goals. The Supreme Court ruled that the regulation leading to extinction of a residence permit due to absences greater than six months was unconstitutional and thus expelled that particular reg (art. 162.2.e RD 557/2011). But if your plan, for example, is to obtain long-term residence, long-term EU residence, or citizenship, you’re going to need to hunker down in Spain (not even in the EU: in Spain) with limited absences. (maximum 10 months in 5 years)”

“It is better to seek professional advice. I have seen all sorts of wrong answers being given out on all pages. Some advice is very useful but for legal matters, it would be best to consult a professional.”

Conclusion

Maintaining the Spain Digital Nomad Visa (DNV) and potentially converting it into long-term residency or citizenship requires a substantial presence in Spain, specifically limiting absences to ensure eligibility for future residency or citizenship applications.

The recent Supreme Court ruling has modified previous strictures about absence from Spain, but those aiming for long-term benefits should plan to spend significant time within the country.
