Question
If approved for the Spain Non Lucrative Visa, do you need to sign a year-long lease or commit to a long-term living situation? Or can you stay in short-term rentals? I want to be in Valencia 8 months of the year, not 12, and in northern Spain the rest of the time.

These are the answers of Spainguru’s Facebook group members:
(Lawyer’s answer) “For the first time Spain Non Lucrative residency card in Valencia, you do NOT need a padron or fixed address. When you renew in one year you need a Padron. However, you could get the Padron one day before applying. Therefore, you could live 8/4 months in different places, then when you renew get a Padron.”
“I believe you can be away 10 months in the five-year period, unless you don’t care about the permanent residency.”
“It’s more to do with getting your padron (which you then need for your TIE appointment). To get the padron you need to show a rental agreement that isn’t short term, like Airbnb usually is. Some people get around this by getting their Airbnb host to sign a ‘real’ rental contract, or using a friend’s address instead.”
(Lawyer’s answer) “I have personally accompanied hundreds of people for appointments in Valencia and never had a problem. We are immigration lawyers based in Valencia.”
“Wait times to make appointments can be long, sometimes taking months. The TIE card takes typically 25-30 days after you give your fingerprints.”
Conclusion
The Spain non lucrative visa offers some flexibility regarding residency requirements, particularly in places like Valencia. For initial residency, one does not need a fixed address or padron, but requirements tighten upon renewal.
Creative solutions like securing a ‘real’ rental contract from short-term arrangements or using a friend’s address can facilitate the process. However, navigating these requirements often benefits from professional legal assistance, especially to ensure compliance with local immigration laws and timelines.
