Question
Houston Consulate/BLS Spain Non Lucrative Visa applications: Did they accept an affidavit that your employment WOULD end as of a certain date, or only accepting it for NLV if you are ALREADY retired?
Answers
These are the answers of Spainguru’s Facebook group members:
“Check the website to see if this requirement is clear. If vague then you can also be vague in your letter.”
“Actually did… and unclear if the ‘vague’ is a linguistics issue or other. Hate to guess wrong, hence the ask here….”
“12. Affidavit: If the applicant is of working age, they must provide a letter of termination from the employer stating that they will no longer work for that company or, a sabbatical year acceptance letter from the employer.
In any case, the applicant must provide a sworn statement before a notary, including the following information:
- A brief explanation by the applicant of their professional background, the reasons why they have decided to live in Spain, how long they plan to stay, and any other reason to support the visa application.
- The postal address in Spain, where the applicant will live, at least, for the first three months.
- The commitment of not doing any gainful work, by any means, either on-site or remotely (online), while residing in Spain.
Your work does not have to be terminated when you apply. You can write that you’ll leave the job when your visa is issued or before you leave for Spain.”
Conclusion
According to responses from the Spain Non Lucrative Visa community, the Houston Consulate does not require applicants to be retired at the time of applying.
Instead, applicants can submit an affidavit stating that their employment will end by a certain date before moving to Spain.
Additionally, a sworn statement before a notary is required, confirming the applicant’s professional background, intended stay, and commitment to not working while in Spain. If the consulate’s requirements appear vague, it may be best to clarify with them directly or provide the necessary documentation with clear intent.
