What is the procedure for filing a complaint against a solicitor in Spain?

Last Updated on March 18, 2026 by Bruno Bianchi

Question

I wrote recently about a solicitor in Motril who had made a mistake on our non residents  modelo 210 tax forms, by putting one name, instead of both the names as per the escritura. Now, it appears they are unwilling to rectify/pay for their mistake. So, what are my options before I name and shame?  Can I complain to any legal organisation? What is the process to complain about a solicitor in Spain?

“Try colegio oficial de abogados. However you are supposed to check what you/they have written down before signing.”

“You send a letter by registered mail and you state

1. The mistake they made

2. You ask them to rectify

3. You also ask them to notify to their professional insurance”

“Don’t ‘name & shame’ them ’cause you may only regret it if you get sued for libel! Try making a formal complaint to the Colegio de Abogados – but remember the quote from a certain well-known book: “He that is without sin among you, let him first cast a stone…”. Probably not worth trying to get a lawyer to sue another lawyer, as «PERRO NO COME PERRO».”

“The Colegio de abogados of the province they are registered at, which will either be the one in the province where their office/offices is/are or a neighbouring province, will in all probability have an arbitration service and the solicitor will either as an individual or as part of a partnership definitely have professional indemnity insurance. Check if you have a legal advice/assistance add on to your household insurance which might provide you at least with some advice about how to start the process. OR take advice from a different solicitor.”

“If you have home insurance they might complaint to the colegio de abogados of your lawyer. But this stuff takes time to be sorted out”
