“In order to keep your residency rights on a Spain Non Lucrative Visa you won’t be able to leave the country for more than 6 months in any 1 year period. Or a total of 10 months during the first 5 years of residency if you want to obtain the Long-term residence permit.”

“Before putting the cart before the horse and totally messing up your Visa, I would check with an attorney. With all the work I put into getting the Visa, I can only assume you did the same. So, calm down and consult an attorney…don’t burn your bridges.”

“I personally wouldn’t try to test breaking the 6-Month Minimum Stay because it sounds like they might put it back in place. I still don’t understand why people want to get an NLV if they’re not going to be in Spain most of time. “

Conclusion

The recent changes regarding the non-mandatory six-month stay under the Spain Non-Lucrative Visa have sparked confusion and interest among potential applicants.

While the flexibility to leave Spain for up to six months annually may seem appealing, it is essential to remember that a total limit of 10 months outside Spain applies over the first five years to maintain residency rights.

Continuous absence may jeopardize the renewal of the NLV, which is designed for individuals intending to reside in Spain long-term. To understand the current situation of the 6-month requirement for NLV renewal, we highly recommend reading Supreme Court eliminates the 6-Month stay rule for non lucrative Spain visa renewal.
