Question
A lawyer told me today about new requirements for the Spain Digital Nomad Visa: apparently in the past few weeks (October 2024), they have been asking everyone who is applying with their own business as their source of income to provide detailed information about the clients that fund the business, including apostilled documents.
This is something that should appear on the list of requirements for the application, but does not. I will check on this with other lawyers, but please do comment if you have experienced this extra layer of investigation during your application process.

(Lawyer answer): “This is not correct in general, there have been no change in the requirements.
I have been checking up on it and there seems to be one or two isolated cases where some additional information was requested on clients, after already submitting an application.
This is not a new requirement and was never a requirement previously. The UGE/DN office are not asking “everyone who is applying” to show this.
Also there is no source to confirm this information and seems to a rumour from one lawyer.
There is no problem to have this information just in case, however the UGE have instructed us to not add additional information if it is not expressly needed.
SUMMARY:
Business owners who have a contract with their own company/LLC/Ltd do not need to present any information of their clients. If the DN office want that information they will ask for it.
After hundreds of applications, for business owners we have never had this request.
Contractors who don’t have a registered company need to show the contract with a business client(s), the clients company registration, invoices, etc. However you do NOT have to show accounts.
The DN office have the right to request any additional information they require. This usually is for documents you should have provided but did not. However if they have doubts on anything they can ask for additional proof outside the requirements to prove this.
There is a possibility that the person revising the case makes a mistake, it happens, and this can be very confusing and frustrating.”
(Lawyer answer): “We have not been asked to provide evidence of partners and shareholder clients in general.
In only 2 cases the shareholder information was required.
1) The apostille was stamped by a Notary and the company had changed name from when it was founded.
2) The contract pay was very low and supplemented by dividends. Proof of being a shareholder was required.
The key is to present the exact documents the UGE require.
– Contract with the LLC, better to be signed by someone else.
– LLC Cert of formation/registration with:
> Name of LLC
> Date of incorporation
NOTE: Your name does not need to appear.
– 3 months invoices from you to the LLC
– 3 months personal bank statements showing payment of the invoices.
– Simple letter giving permission to work in Spain, better if another person signs it.
– Avoid using the word “Director”
Errors can be made in the letter, contract and CV, that show a contradiction or typically in the letter give too much information, rather than just stating what is required: “John has permission to work remotely in Spain. He has been working for this company since 2018”

Applicants owning businesses do not generally need to provide detailed client information unless specifically requested by the UGE/DN office.
