Question
Hi, I’m wondering if anyone has experience with declaring that you are no longer a tax resident in Spain after moving to another country.
My Spanish Accountant has advised me that I should file Modelo 030 to inform Hacienda and officially end my “tax home” in Spain.
I’d love to hear experiences from anyone who’s filed this form, or left Spain without filing it. I’m no longer in Spain and don’t have a digital certificate, so I’m wondering if I can get away with not filing it or if it’s hard requirement.
Answers
These are the answers of some Facebook group members:
“Always inform the Tax Office, especially if you still own property here.”
“If you do not file this form you remain tax resident in spain. If you prefer tax bills, freezing of accounts etc do as you please. Every country has same procedures needing to notify tax office of change in residency. You should also have baja on padron too.”
“Your accountant is right and can file it for you”
“I’m not sure if it’s strictly necessary but my accountants just advised me of the same thing. They filed it for me.”
In conclusion, it is advisable to inform the Spanish Tax Office through filing Modelo 030 when leaving the country to officially end one’s “tax home” in Spain. Failure to file this form could result in remaining a tax resident in Spain and potential issues with tax bills and freezing of accounts. While it may be possible to get away with not filing the form, it is a recommended step to take. Spainguru’s Facebook group members have confirmed the advice of the Spanish accountant and shared their positive experiences with filing this form.
